This Agreement constitutes the entire understanding between the Companies and you concerning the subject matter hereof and supersedes all prior agreements and understandings regarding the same.

Our Commitment to Privacy

Your privacy is very important to us. To better protect your privacy, the Companies provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested.

The Information We Collect

This notice applies to all information collected or submitted through HEART – Health Education And Risk Test™, START – Sports Training And Readiness Test, or through other aspects of your use of the Companies’ “Wellness Program.” The types of personal information collected consists of: Name, Address, Email Address, Phone Number, Whether You Smoke, Your Alcohol Consumption, Whether You Eat Red Meat, Frequency and Duration of Exercise, Whether You Weight Train, Whether You Have Back Pain, Blood Pressure, Waist Circumference, Height, Weight, and Body Mass Index. We also may take your photograph or make audio or video recordings of you during your assessments, which you have agreed we will own and may use as we see fit.

Your health information is not linked to the personal information you provide during registration.

Your health information is stored in de-identified form on a separate server, and is only used by the Companies in aggregate with other users of the assessments. This means that the information will be stored in a matter that does not permit the identification of a specific individual without extraordinary effort, and your right to privacy is retained. This information is solely owned by the Companies, and by acceptance of our Terms and Conditions, you acknowledge and waive all rights to such information. The Companies may disclose or sell your information to other parties, including but not limited to sponsors, researchers, commercial entities and third party service providers of the Companies.

The Way We Use Information

We currently use the information you provide about yourself to, among other things, provide you with HEART and/or START scores, representative of your risk factors for cardiovascular disease based on the information that you provide to us, as well as to design a customized workout program. We use return email addresses to answer the email we receive and communicate with you about the Companies’ products and services. We may use your image when we show you your HEART or START score and may also use your image or recordings of you on the website or in other marketing and promotional materials. As stated above, we reserve the right to use, including sell, the information to our affiliate, subsidiaries and third- parties in other ways as we see fit.

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site.

We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser.
